THE NEED FOR LEGAL, ADMINISTRATIVE & JUDICIAL REFORMS IN INDIA

February 29, 2020

The legal system of India is one of the oldest legal systems compared to the legislative systems of the other nations in the world. It has significantly evolved and progressed within the past few centuries in order to engage inferences from legal systems around the world. India is the nation of varied local customs, various cultures and diversified conventions that are no obstructions to the statue or ethics. Parts of the population belonging to different religions, cultures, and traditions are operated by several sets of individual laws that demand the need for administrative, legal, and judicial reforms in India to a great extent. Moreover, with the rising political impacts, the socio-economic changes, increase in population, and illicit practices have made law reforms one of the essential aspects of the evolving society.

The Current Procedure of Law Reform in India

The law reform is a procedure through which legal aspects are advanced and shaped in order to reflect the social values that are significant over time. Law in modern society cannot be stagnant, and law reforms are hence emphasized significantly to drive motives and new changes in the system for better implications. Authorities are emphasizing on examining the existing laws on a different level, implementing and advocating certain changes in the legal system, generally with the goal of improving justice and efficiency in the overwhelming legal landscape of India. Intimately related are law reform bodies or law commissions, which are organizations set up to facilitate law reform.

The Rising Need for Law Reform

The Indian government is looking forward to enhancing the ease of living when it comes to the lifestyle of the common man. There is the noble sentiment behind the motive. Other than maintaining and enhancing the regulation of law, taking strong action against sectarian provocation and vigilante violence are also the top priorities of the Indian government when it comes to Law Reform. The aim behind establishing substantial legal reforms is to make the criminal justice system function more efficiently and faster than ever before. Here are some of the key reasons that make law reforms in the Indian legal system more imperative than ever before:

  • High level of investigation

One of the leading reasons to emphasize and progress legal reforms is to bring about a better and more profound investigation of cases. Reports state that the lack of investigation strategy is caused by a lesser understanding of existing legal claims, law implementation, and legal norms. Besides, since legal justice, on many occasions, tends to be overlooked, the Indian government is striving to improve through legal reforms.

  • Faster Trial

The current reputation of the system of justice among the general population is that it commonly gets delayed and is even out of the reach of normal people except for the moneyed ones. To avoid such disputes, the law of commission has recently declared establishing of a new court in each district and appointing a substantial number of new judges. Reforming the entire system of appointing judges and also holding the functioning in order to account for it is yet again another priority.

Legal, administrative & judicial reforms are the top primacies of the Indian legal system at present. And looking at the pace at which the reforms are being introduced, we, at the K.R. Mangalam University’s School of Law, one among the most renowned Law Colleges in Delhi NCR, have made it a point to keep our students updated in all aspects. At llb course in Haryana, we not only teach our pupils about the Indian legal system but also ensure that they are provided with all the opportunities to expand their horizons of knowledge. Recently our students and faculty participated in an event organized by the Pranab Mukherjee Foundation at O.P. Jindal University, Delhi campus, Qutab institutional area, which was based on the ‘Criminal Justice System in India.’ It was one of the most active and influential events that demonstrated, discussed, and redefined the Indian Legal, administrative, and judicial reforms. The event mainly emphasized the current criminal justice system of India and the requirement for several legal, administrative and judicial reforms. Our students, as well as the faculty, get to gain deep insights into the topic by being a part of the event.
